Where this
sits.

This agreement sits alongside the Privacy Policy and the Street Rules provided at your induction.

Where anything below differs from something you have been told, shown, or read elsewhere, these membership terms apply.

Contents

Twenty four
sections.

Section 01

The membership.

A Street membership is an ongoing, members only commitment to training across our Reformer and Mat rooms. You choose your weekly frequency, your membership renews automatically every 7 days, and you book your own sessions through the Momence app.

Memberships are billed weekly in advance. Your membership continues until you cancel it in line with the notice terms in section 06.

  • Frequency: your chosen weekly frequency, as shown on your membership in the Momence app
  • Rooms: Reformer and Mat, subject to availability and booking
  • Billing: Weekly in advance, every 7 days, via Momence
  • Term: Ongoing until cancelled
Section 02

Membership
and pricing.

Membership prices are shared at sign up and shown in the Momence app.

MembershipFrequency
Street Two2x per week
Street Three3x per week
Additional frequencies4x or 5x per week, subject to availability

Founding members join under a named wave: First Call, Second Call, or Final Call. Your wave determines your rate. Your membership type determines your weekly frequency. Both are shown on your membership in Momence.

Section 03

Price
increases.

Street reserves the right to adjust membership pricing over time. We will always give you fair notice before any change to your weekly price.

  • We will give you a minimum of 2 billing cycles' written notice before any increase to your weekly membership price takes effect.
  • Notice will be sent via SMS, email, or in app message through Momence.
  • If you do not wish to continue at the new price, you may cancel your membership in line with the cancellation terms in section 06.
Founding rates / held, then reviewed annually

A rate secured in a founding wave, being First Call, Second Call, or Final Call, is protected as set out below for as long as your membership runs continuously.

  • Your founding rate will not increase during your first 12 months of continuous membership.
  • After 12 months, a founding rate may be reviewed once per year. Any increase is subject to the same minimum of 2 billing cycles' written notice set out above.
  • A founding rate will always sit below the standard rate in force at that time for the same weekly frequency. That is the permanent advantage of joining in a founding wave.
  • Your founding rate is attached to a continuous membership. If you terminate your membership, or release your spot rather than pay the holding fee during a freeze under section 07, the founding rate ends. If you rejoin later you do so at the pricing in force at that time, subject to availability.
  • Changing your weekly frequency under section 06 does not end your founding rate. You move to the founding rate for your new frequency in the same wave.
Section 04

Booking.

  • All sessions are booked through the Momence app or web platform.
  • Reformer sessions are capped at 6 spots. Mat sessions are capped at 8. Book early to secure your preferred times.
  • Your membership is a weekly session credit. A 2x membership gives you 2 sessions per week, a 3x membership gives you 3, bookable across the Reformer and Mat rooms subject to availability.
  • Founding memberships include one additional session credit per week, bookable in either room, on the same terms as your other weekly credits.
  • Sessions do not roll over. Unused weekly sessions expire at the end of each 7 day billing cycle and are not credited, refunded, or carried forward.
  • If your preferred session is full, add yourself to the waitlist. If a place opens up, you will be notified through Momence.
  • Street reserves the right to cancel a session with prior notice. Where this happens, your session credit is returned and you will be contacted via SMS or in app message.
Section 05

Cancellations,
late arrivals
and no shows.

These terms cover cancelling an individual session. Cancelling your membership is covered separately in section 06.

12 hour cancellation window

Cancellations made through the Momence app more than 12 hours before your session start time are free of charge and your session credit is returned to your account for use within the same billing cycle.

Late cancellation, within 12 hours

Your session credit is forfeited for that cycle. No additional fee applies.

No show

Your session credit is forfeited and a $20 no show fee applies to cover the held spot and your trainer's time.

How to cancel a session

Session cancellations must be made through the Momence app. Messages via text, email, or social media are not accepted as cancellations and do not exempt you from no show fees.

Late arrival and the closed curtain policy

Sessions are 45 minutes. Once the curtain is drawn at the session start time, no further entries are permitted. This is for the safety of every client in the room. Arriving at or after the session start time is treated as a no show and the policies above apply.

Section 06

Commitment,
changes and
termination.

Memberships are ongoing and renew automatically. The following terms cover your initial commitment, changing your membership, and ending it.

Minimum commitment / 6 weeks

All memberships carry a minimum commitment of 6 weeks from your membership start date. This commitment must be seen out in full before a termination can take effect.

  • Extreme circumstances, such as serious illness or injury, may be reviewed case by case. A review is not a guarantee of release, and any decision is made at the sole discretion of We Are Basis Pty Ltd.
  • Requests for review must be made in writing to hello@streetpilates.com.au with appropriate supporting documentation.

Changing your membership, upgrades and downgrades

  • To upgrade or downgrade your membership, for example moving between 2x and 3x per week, we require 7 days' written notice.
  • The change becomes enforceable after 1 full payment cycle has passed from the date we receive your request. Your existing rate applies until then.
  • Change requests must be made in writing to hello@streetpilates.com.au.
Strict termination policy / 2 weeks

Once your 6 week commitment has been met, our termination notice period is 2 weeks, equal to 2 direct debit cycles. This notice period must be seen out in full. You will be billed for 2 further direct debit cycles from the date valid written notice is received, and your membership and booking access remain active across that period. Your membership ends at the close of the second cycle.

  • Notice of termination is only valid once it has been provided by email and the required termination form has been submitted in the correct format and in line with our protocol. Notice given by app, text, social media, or verbally is not accepted and does not start your notice period.
  • The full termination request process can be requested from hello@streetpilates.com.au. Your 2 cycle notice period begins only from the date a complete and correctly submitted request is received.
  • You remain responsible for the 2 direct debit cycles during your notice period, whether or not you attend sessions in that time.
  • Where you are terminating because of a price increase, the same 2 direct debit cycle notice applies, calculated from the date a valid request is received.
Important / cancelling your direct debit

Cancelling, pausing, or disabling your direct debit does not end your membership and does not satisfy the termination process above. Your membership can only be ended by following the strict termination protocol in this section.

  • If you disable or stop your direct debit outside of an approved termination or freeze, without written approval from We Are Basis Pty Ltd, your membership remains active and any payments you were due to make remain owing.
  • Unpaid amounts that build up this way are treated as an outstanding debt to We Are Basis Pty Ltd. We reserve the right to recover this debt, including by referring the outstanding amount to a third party debt collection agency.
  • Where a debt is referred for collection, any reasonable recovery, administration, or legal costs incurred may be passed on to you and added to the amount owing, to the extent permitted by law.
  • To avoid this, always end or change your membership through the correct written process in this section. If you are having trouble with payments, contact us at hello@streetpilates.com.au before disabling your debit and we will work through it with you.
Section 07

Freezing your
membership.

Life happens. You can pause your membership rather than cancel it.

  • You can freeze your membership for up to 4 weeks at a time. During a freeze, you are not billed and you do not lose your spot.

After 4 weeks

Once your 4 week freeze is up, you have two options.

  • Hold your spot: pay a weekly holding fee of $12 to keep your membership and your place in the room reserved beyond the 4 weeks.
  • Release your spot: forfeit your membership and hand your place to the next person on the waitlist. If you want to return later, you rejoin at the standard pricing in force at that time, subject to availability.
  • Freeze requests must be made in writing to hello@streetpilates.com.au before the freeze start date.
  • The weekly $12 holding fee is non refundable and does not count toward sessions.
21 Day Routine Kickstarter exception

Freezes apply to memberships only. The 21 Day Routine Kickstarter does not freeze, pause, or extend. When you buy the Kickstarter you are committing to the full 21 days, and all 9 sessions must be used within that window. No pauses, freezes, or extensions are granted for any reason, including illness, travel, work, or change of circumstance. Unused sessions expire at the end of the 21 days and are not credited, refunded, or carried forward. The Kickstarter is a one off purchase, not a membership, and does not renew.

Section 08

Pre session
screening.

Before your first session you will receive a pre session screening form through Momence. Completing this form is mandatory before you attend any session. The screening covers your training history, current conditions, injuries, pregnancy, recent surgeries, and your preferences around tactile cueing, meaning hands on corrections.

  • If you do not wish to receive tactile cueing, you must indicate this in the pre session screening. Verbal notice at the studio cannot be reliably accommodated and your trainer may default to standard coaching protocols if the screening is incomplete.
  • If you have a condition, injury, or change in health, it must be disclosed in the screening. Telling your trainer for the first time on arrival is not acceptable. Your trainer may turn you away from that session to protect your safety, and a forfeited session in this situation is not credited back.
  • If anything changes during your membership, such as a new injury, illness, or pregnancy, update us in writing at hello@streetpilates.com.au before your next session.
Section 09

Modifications,
injury and trainer
discretion.

Street offers modifications, not substitutions. Modifications are building blocks toward full range movement, not ongoing alternatives. Where your needs go beyond what can safely be coached in a small group setting, your trainer may take one of the following actions.

  • Refer you to a 1:1 session with Annie so the work can be tailored to you.
  • Ask you to seek clearance from a physiotherapist, osteopath, doctor, or clinical Pilates practitioner before continuing in group sessions.
  • Honestly suggest an alternative training environment if Street is not the right fit for your current circumstances. We would rather send you to the right space than have you train somewhere you cannot progress safely.

Your trainer holds the final discretion on whether group sessions are appropriate at any time. This decision is made on safety grounds and is not negotiable in the moment.

Section 10

Health, safety and
assumption of risk.

Reformer and Mat Pilates are physical training activities and carry inherent risks. By holding a membership and participating in any session, you acknowledge and agree to the following.

  • You are voluntarily participating with full knowledge of the risks involved.
  • You confirm you are physically capable of participating safely or have disclosed any relevant conditions in your pre session screening.
  • You will follow your trainer's instructions, modifications, and equipment guidance at all times.
  • You will use equipment only as instructed and only when supervised. Unsupervised use of equipment is not permitted.
  • You will not attend a session if you are unwell, contagious, or running a fever. Where this applies, cancel through Momence within the 12 hour window where possible.
  • You release Street Pilates, We Are Basis Pty Ltd, and its trainers from liability for any injury, loss, or damage sustained during participation, to the extent permitted by law.

This clause does not limit your rights under the Australian Consumer Law or any non excludable consumer guarantees.

Section 11

Personal
belongings.

  • Personal belongings must be left in the designated belongings area. Phones, bags, and valuables are not to be brought into the training space.
  • Street accepts no responsibility for loss, theft, or damage to personal property brought into or left on the premises.
Section 12

Recording and
phone use.

Phones are not permitted on the studio floor during sessions. Recording other clients, the trainer, or the session content for any purpose is not permitted without prior written consent from Street Pilates.

Section 13

Refunds.

  • Membership payments are non refundable except where required by law. Weekly billing is taken in advance for the cycle ahead.
  • Refunds will only be issued in accordance with Victorian Consumer Affairs regulations and the Australian Consumer Law.
  • Refunds processed for reasons external to Street Pilates are subject to a $5 processing fee.
  • Approved refunds will be processed to the original payment method.
  • Change of mind, change of address, change of schedule, and dissatisfaction with results are not grounds for refund, except under the Love It Or Leave It guarantee below.
Love it or leave it / 21 Day Kickstarter only

If you buy the 21 Day Routine Kickstarter and decide Street is not for you, you can have your money back in full.

  • You must have completed 3 sessions within 7 days of your first session.
  • You must tell us in writing at hello@streetpilates.com.au within 14 days of your first session.
  • The refund is the full $200. The $5 processing fee above does not apply to this guarantee, and grip socks already issued are yours to keep.
  • The refund is processed to your original payment method within 10 business days.
  • This guarantee applies once per person and does not apply to memberships, Open Floor tickets, or any other purchase.
Section 14

Photography
and consent.

By attending any session, you acknowledge that you may be filmed or photographed for marketing and educational purposes across digital, print, and social media. If you do not wish to appear in any media, indicate this in your pre session screening or notify your trainer in writing before your first session. We will tag your profile and do our best to keep you out of frame in every session.

Section 15

Privacy
and data.

Personal information collected through Momence and Street Pilates is handled in accordance with our Privacy Policy. Momence is our booking and payment platform and stores your details securely. By starting a membership, you consent to your information being processed by Momence for the purpose of delivering our services.

Section 16

Communications.

By starting a membership, you consent to receive operational communications from Street Pilates and Momence relating to your sessions, account, billing, and membership. This includes SMS, email, and in app messages. Marketing communications can be opted out of at any time using the unsubscribe link in the communication.

Section 17

Behaviour and
studio conduct.

Street is a small, coached environment. Respect for your trainer and fellow clients is non negotiable. We reserve the right to terminate this Agreement without refund for behaviour we determine to be inappropriate, offensive, unsafe, or directed at our staff or other clients. This includes verbal abuse, aggression, harassment, attending the studio under the influence of alcohol or recreational drugs, or any conduct that compromises the safety or experience of others.

Section 18

Hygiene
and illness.

  • Do not attend the studio if you are unwell, contagious, or have a fever. Where this applies, cancel through Momence as early as possible.
  • Grip socks are required in every session for hygiene and safety.
  • Equipment must be wiped down at the end of every session using supplies provided.
Section 19

Force majeure and
operational changes.

Street is not liable for any failure or delay in performing its obligations under this Agreement caused by events outside our reasonable control. This includes illness of the trainer, natural disaster, fire, flood, power outage, public health orders, government directives, or any other event that prevents the safe operation of the studio. Where a session is cancelled for these reasons, your session credit is returned to your account and where possible an alternative session is offered within the same billing cycle.

Section 20

Complaints
and feedback.

If you have a concern about your membership, raise it in writing to hello@streetpilates.com.au within 7 days of the event giving rise to the concern. We will respond within 5 business days. Concerns raised outside this window may not be actionable.

Section 21

Changes to
this agreement.

Street reserves the right to modify this Agreement and the terms of membership. Where a change materially affects your membership or pricing, the notice terms in section 03 apply. The version of this Agreement in force at the date of any change governs your membership from that point.

Section 22

Severability and
entire agreement.

If any part of this Agreement is found to be unenforceable, the remainder continues in full force. This Agreement, together with the Street Pilates Privacy Policy and the Street Rules provided at induction, forms the entire understanding between you and Street Pilates relating to your membership. It supersedes any prior representations, promises, or statements not contained in these documents.

Section 23

Governing law.

This Agreement is governed by the laws of Victoria, Australia. Any dispute arising under this Agreement is subject to the jurisdiction of the courts of Victoria.

Section 24

Acknowledgement.

By starting a Street membership, you confirm that you have read, understood, and agreed to this Agreement, the Street Pilates Privacy Policy, and the Street Rules provided at induction. You also confirm that you will complete your pre session screening accurately before your first session and update it in writing if anything changes during your membership.
